We provide our services through our web app and mobile application known as ZaimusConnect (“App”), and its supporting systems (Collectively the “Platform”). The terms “Institute” and “Institution” refers to the school or college. The terms "you," "your," and "yours" refer to the authorised user of our platform who may be parents, teachers, principal and other staff or people of the institute. The terms "Company," "we," "us," and "our" refer to Zaimus Technologies Private Limited (“Zaimus”). This Privacy Policy is governed by our Terms of Service. By using this platform, you consent to the data practices described in this statement.

For us to provide you the Services, it is essential for us to collect some basic information about you. Accordingly, you consent to the collection, storage and use of the information in accordance with this Privacy Policy.  We may periodically make changes to this Privacy Policy that we will include on this page and will try our best to keep you informed. We encourage you to visit this page often to review this Privacy Policy frequently and remain informed about any changes to it.

Privacy Guidelines

This Privacy Policy has been drafted by us in accordance with the Information Technology Act, 2000 and is subject to the Terms of Use and constitute a valid and legally binding agreement between you and us.

You will be required to change your password and choose a strong one. You will be responsible to maintain the confidentiality of your password.

We make sure to store and protect your personal information by employing adequate and reasonable security measures in accordance with law.

Personal identity Information

"Personal identity information" means any information that may be used to identify an individual, including, but not limited to, a first and last name, home or other physical address, an email address, phone number or other contact information, whether at work or at home. When you use our services, platform identifies you by user name and the personal identity information are hence known to the platform. Platform also automatically receives and records information on our server logs from your browser, including your IP address, cookie information and the page you request.

Your information will not be considered as sensitive and confidential if it is freely available and/or accessible in the public domain.

Usage of Services provided by the platform

1. You understand that the services of the Platform is provided to you as per the agreement we have with the school / college (being our Direct Customer).
2. You (parent) provide the data of you and your child(s) to the school which in turn is entered / uploaded into the platform.
3. The user name and password for accessing the platform is provided to you by the institution.
4. You may not copy, modify, distribute, sell, derive another work or lease any part of our Services or App, nor may you reverse engineer or attempt to extract the source code of the App, unless laws prohibit those restrictions or you have our written permission.

1. The information we collect

User Profile

1. For using the App we collect the following information when a user account is created for you by person authorised by the institute.
   • Your full name
   • Your e-mail address
   • Your mobile number
   • Occupation
2. We enable you to upload a profile picture to your account.

Usage Information

1. When you use our App the platform will automatically collect the following information and is stored on our server.
   • Your IP address;
   • The website url you used to access the app;
   • The App feature or pages used by you;
   • Browser types and information, operating system;
   • App (web / mobile) access date, time and duration;
   • app crashes and other system activity
2. To assist in development, we may keep copies of HTTP requests and responses in our server log file.
3. You understand that the services of the platform is provided to you as per the agreement we have with the institute (being our Direct Customer), we take no guarantee of the way the information shall or will be used by them.

Location Information

When you use our Platform, we collect your location data if you provide us specific permission in this regard through App. If you permit the mobile App to access your location through the permission system used by your mobile operating system, we may also collect the precise location of your device when the App is running in the foreground or background.

Platform also collects the location of the institution bus through GPS device or App and is used for live bus tracking feature.

Your location is used for live bus tracking feature and needed only if live bus tracking option is provided by the institute and you are using the transportation facility provided by the institute. If live bus tracking option is not required by you, then you can safely deny the location permission when prompted.

Device Information

We may collect information about the devices you use to access our services, including the operating systems and versions, hardware model, software, our app versions, serial number, preferred languages, unique device identifiers, advertising identifiers, and mobile network information.

2. How We Use Collected Information

User Profile

Your information is used to enable you to use our services, to provide support,  to send you personalized and relevant communications, to verify your identity for App access and payments (online fee payment for parents), and to improve our services.

We may use the information provided by You to resolve disputes that may arise with the use of Our Services, help promote a safe service to all the Users of the Platforms, and to enforce Our terms and conditions.

We may periodically send e-mails on information about enhancements, new features of the App/Platform and to notify you of technical updates or changes in policy.

Usage Information

We use this information to enable and improve your experience with our App; to help us better understand your usage of our platform; for Internal record keeping; to research and develop new services and features; to improve the functionality of our services and to prevent, detect, and combat fraud.

We use Your IP address to help diagnose problems with our server, and to administer Our Platforms.

Location information

Your location is used to show your position relative to the institution bus so that you can know how far or near the bus is.

Bus location is used to provide trip status, history, speed and stoppages to school authorities.

Device Information

This information helps us communicate with you by sending notification messages on any activity of importance to you happens on the platform like new diary entry, child absence, homework, assignment, mark, fee payment etc.; protect your safety and security; optimize and improve your experience; and prevent, detect, and combat fraud.

We may periodically send notification on information about enhancements / new features of the App/Platform.

3. Sharing of Information

We will not sell your information with anybody. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your personally identifiable information with certain third parties without further notice to you, as set forth below:

1. Legal Requirements and Other Circumstances:  We have to disclose your Information, (i) if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. (ii) protect and defend our rights or property. (iii) We may disclose this information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to enforce our Terms or Privacy Policy. (iv) act in urgent circumstances to protect the personal safety of users of our or services or the public.
2. Business Transfers:  As we develop our business, we might sell or buy businesses or assets. Your Information may be shared / transferred in the form of assets with another business entity should We (or our assets) plan to merge with, or be acquired by another business entity, or re-organization, amalgamation, restructuring of business. You acknowledge that such transfers may occur, and that any acquirer or successor may continue to use your information as set forth in this policy.
3. Related Companies:We may also share your personal identity information with any entity that is affiliated with us for purposes consistent with this Privacy Policy.
4. Agents, Consultants and Related Third Parties: Zaimus, like many businesses, sometimes uses other companies to perform certain business-related functions. Examples of such functions include maintaining databases, App hosting, SMS, Push Notification and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

1. All information is saved and stored on servers, which are secured with passwords and pins to ensure no unauthorized person has access to it. Once Your information is in our possession, we adhere to strict security guidelines, and to the best extent possible protecting it against unauthorized access.
2. We store your information over secure cloud service providers who offer security standards competitive with the industry norms. We also protect our servers with firewalls and data encryption using SSL, and information access authorization controls. We use reasonable safeguards to preserve the integrity and security of Your information against loss, theft, unauthorized access, disclosure, reproduction, use or amendment. To achieve the same, We follow generally accepted industry standards to protect the personal identity information submitted to us, both during transmission and once we receive it. Information You provide to Us may be stored on Our secure servers located within or outside India.
3. However, You understand and accept that no method of transmission over the Internet or method of electronic storage is, however, 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal identity information, we cannot guarantee its absolute security. We assume no liability for any disclosure of information due to errors in transmission issues, unauthorized third-party access to our Platform and data bases or other acts of third parties or acts or omissions beyond Our reasonable control and You shall not be entitled to hold the Company responsible for any breach of security except in case of wilful negligence on the part of the Company.

5. Content

1. You, if parent, can only access data of his/her child. Teacher can access data of his/her class. Principal can access data of all students of the institute.
2. Permission to access various screens and data access are provided on a role based concept and is set / decided by the institute. Screens available to you is based on the role associated with you. For any permission based queries / changes you will have to get in touch with the institute’s person in charge for the app.
3. We don’t provide / enter any personal information, media files into the platform. These are provided / entered by you.
4. For any data related correctness / issues you will have to get in touch with the institute authorities.
5. Some of our services allow you to upload, and send content. For example, images uploaded to photo gallery, profile photo, assignment etc. You retain ownership of any intellectual property rights that you hold in that content.  If you are uploading files / content that is not owned by you or provided by third party applications or services, please make sure that you are allowed to do so and there is no legal violation of any sort. Please review carefully the applicable policies and terms of use of each such third party application / service provider to become familiar with their policies and practices.
6. We are not responsible for the accuracy or correctness or ownership of any such information you provide to the platform. You undertake to indemnify us for any losses that we may suffer due to any claim raised against us with respect to any data and/or information that is provided by you to the platform which are not attributable to negligence, fraud or misrepresentation on our part. This is also applicable to files uploaded by you.
7. The Platform and any services thereon are being provided to you as a service on a revocable, limited, non-exclusive, and non-transferable license.
8. You will not remove or obscure any copyright notice, trademark notice, or other proprietary rights notices displayed on or in conjunction with the Content.
9. Complete ownership, title and full intellectual property rights associated with the App / platform belongs to us.

6. In App Communication / Conversation

If you use the conversation or other communication services provided by the platform for communicating with Users of the Institute, you should be aware that any personal identity information you submit there can be read, collected, or used by other users (within the institute) of these services, and could be used to send you unsolicited messages. We are not responsible for any personal identity information you choose to submit in that context or anything arising from such submissions.

7. Links to Other Sites

The content provided by the users of the platform may contain links to other sites that are not owned or controlled by us. For example, during communication between users (In App communication), Assignment / teaching notes etc. Please be aware that We are not responsible for the privacy policies of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website if it collects personally identifiable information. This privacy policy applies only to information collected by this website.

8. Local Storage

Local Storage is a standard that offers persistent offline storage for the App. Some data is stored on your device (mobile / desktop) when you access our platform. This data allow us to recognize users and avoid repetitive requests for information from the platform. This privacy statement covers the use of local storage by Us and does not cover the use of local storage by any other third party.

9. Exit policy

The services of the Platform is provided to you as per the agreement we have with the Institute. In case the contract between us and the Institute has expired and the Institute decides not to renew the contract or extend services, You will not be able to access our services. 

You can stop using our Services at any time, although we’ll be sorry to see you go. Please get in touch with the Institute authority and uninstall the app. Please note, We may still retain some information and record of transactions as required by any law, contract or policy applicable to Us.

10. Your Consent To This Policy

By accessing our platform through our APP, you are consenting to this Privacy Policy. Your continued use of Our App constitutes your agreement to this Privacy Policy and any updates. If you do not agree with the terms of this Privacy Policy, you should discontinue your use of our Platform / App, or any part thereof.

11. About This Policy

This is our entire and exclusive Privacy Policy which supersedes any earlier version. Our Terms of Use take precedence over any conflicting Privacy Policy provision. We may modify this Privacy Policy by posting a new version of this Privacy Policy on this website. You should look at this policy regularly to stay informed about how we are protecting the personally identifiable information we collect.
